A property rental agreement in Thailand, like in any other country, should include essential terms and conditions to protect both the landlord and the tenant. Here’s a general guideline of what should be included:

Names and details of parties

Full names, addresses, and contact information for both the landlord and the tenant(s). The ID Card or Passport details for both parties should also be shown.

Description of Property 

Clear description of the rented property including the address, unit number (if applicable), and any specific details regarding the property’s condition or amenities supplied.

Terms of the Tenancy

Start date and end date of the lease agreement and any penalty for early termination. If it’s a fixed-term lease, specify the duration. If it’s a periodic lease (month-to-month), outline how termination notice should be given.

Rental Payment Terms

Amount of rent, due date, and acceptable payment methods. Include any late payment fees or penalties for missed payments.

Security Deposit

Amount of security deposit required, and who holds it, conditions for its return, and any deductions that may be made for damages beyond normal wear and tear or early termination of the agreement.

Renewal and Termination

Procedures for renewing the lease agreement and conditions for early termination by either party, including notice periods.

LESSEE (Tenant) RESPONSIBILITIES

Property Maintenance

The lessee shall maintain the rented property in a clean and sanitary condition, and undertake minor repairs or maintenance tasks as necessary for the upkeep of the premises. The lessee is to make good any damage to the premises caused by negligence or misconduct of the lessee, his family, guests or staff.

Utilities and Services

The lessee shall pay for all utilities and services not explicitly included in the rent, including electricity, water, internet, cable TV, and telephone, unless otherwise agreed upon in writing.

House Rules

Any specific rules or regulations regarding usage of the premises, alteration of the premises, noise, pets, smoking, guests, etc., should be clearly stated.

Subleasing and Assignment

The lessee shall not sublease, assign, or otherwise transfer the lease agreement or any rights or obligations therein without the prior written consent of the lessor.

Access to Property

The lessee shall provide reasonable access to the property for inspections, repairs, or other necessary purposes. The lessor must give the lessee advance notice to gain access as required by the terms of the agreement otherwise access can be refused until such time has elapsed.

Prohibited Activities

The lessee shall not engage in any illegal activities on the premises, nor shall they cause any nuisance, disturbance, or damage to the property or neighboring properties. Nor shall the lessee keep any materials of a dangerous, combustible or explosive nature, or any illegal substances or narcotics on the premises.

Notification of Issues

The lessee shall promptly notify the lessor of any maintenance issues, repairs needed, or other concerns related to the property. Failure to advise the lessor promptly of any issues may make the problem worse resulting in a bigger, more costly problem which the lessor may have the right to claim against the lessee.

Security and Safety

The lessee shall take reasonable precautions to ensure the security and safety of the rented property, including proper locking of doors and windows, use of security devices provided by the lessor, and adherence to any security measures specified by the lessor.

Vacating the property

Upon termination of the lease agreement, the lessee shall vacate the premises and return all keys and access devices to the lessor in the condition specified in the agreement, subject to reasonable wear and tear.

Rent Payment

The lessee agrees to pay the rent on time, in the manner specified in the agreement, without any deductions unless explicitly agreed upon by the lessor (landlord).

Compliance with Laws and Regulations

The lessee agrees to comply with all applicable laws and regulations including but not limited to those related to the use of the property, occupancy limits, noise restrictions, and waste disposal.

Insurance

The lessee is responsible for obtaining and maintaining appropriate insurance coverage for their own personal belongings and liabilities, and shall not hold the lessor liable for any loss or damage incurred.

LESSOR (Landlord) RESPONSIBILITIES

Property Condition

The lessor guarantees that he/she has the right to let the premises and agrees to deliver the rented property to the lessee in a habitable condition, complying with all relevant health, safety, and building codes.

Tenant Privacy

The lessor shall respect the lessee’s right to privacy and refrain from entering the property without proper notice, except in cases of emergency or as otherwise permitted by law.

Compliance with Laws and Regulations

The lessor agrees to comply with all applicable laws and regulations governing rental properties, including but not limited to those related to safety standards, rental law, landlord-tenant rights and payment of any taxes and levies against the property and issuing receipts for rental payments if requested.

Repairs and Maintenance

The lessor shall be responsible for maintaining the structural integrity of the property, including major repairs such as roofing, plumbing, and electrical systems. The lessor agrees to promptly address any maintenance issues or repairs necessary to keep the property in good working order.

Utilities and Services

The lessor shall ensure that all utilities and services specified in the agreement, such as water, electricity, and internet connection are operational and accessible to the lessee throughout the tenancy period, unless otherwise agreed upon or where the lessee causes damage due to negligence.

Immigration Department Notification for foreigners

The Form TM.30 (Notification from the House-Master, owner or the possessor of the residence where alien has stayed) shall be completed by the LESSOR by the lease commencement date or within 24 hours after this date.

Security Deposit

The lessor agrees to handle the security deposit in accordance with the law and return it to the lessee within the specified time frame after the end of the tenancy, minus any lawful deductions for damages beyond normal wear and tear.

JOINT AGREEMENT BETWEEN LESSEE AND LESSOR

Termination of Agreement

The Lessee and Lessor agree that should the property be destroyed or become untenable by acts of God, fire, insurrection, civil war or other such occurrences, and not because of negligence or misconduct by the Lessee, his family or staff, the agreement shall be terminated and any rent paid in advance and the deposit shall be refunded in full to the Lessee within an agreed number of days of termination.

Notification

If the Lessee acts contrary to the terms of the Agreement, the Lessor may notify the Lessee in writing of any breach of the Agreement.  If the Lessee fails to correct the breach within an agreed period, the Lessor may terminate the agreement and the Lessee shall vacate the property within an agreed period of said notice.

Relevant Governance

The Agreement shall be governed by the laws of Thailand in all matters, including any not specifically mentioned. The Agreement is made in duplicate with identical wording.  Both parties acknowledge that they have read and fully understand the contents, and agree to comply with all the terms and conditions stated. The Lessor and Lessee each sign a copy in the presence of a witness and each party keeps a copy of the signed Agreement .
